Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tameru mobile application, website at https://tameru.app, and related services (collectively, the "Service") operated by Tameru ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Notify us immediately at support@tameru.app if you suspect unauthorised access.
• You may not share your account or transfer it to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload content that infringes third-party intellectual property rights, is defamatory, harassing, or contains malware.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape, mine, or extract data from the Service without our written consent.
• Interfere with or disrupt the integrity or performance of the Service.

4. Subscriptions and In-App Purchases

a) Subscription Plans

Tameru offers optional paid subscription plans ("Subscription") that unlock premium features. Subscriptions are offered on a monthly or annual basis as described in the app at the time of purchase.

If we offer a free trial, your subscription will automatically begin charging at the end of the trial period unless you cancel before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

d) Price Changes

We may change subscription prices at any time. Price increases will be communicated to you in advance. Continued use of the Service after a price change constitutes your acceptance of the new price.

e) Billing and Refunds

All purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms and refund policies. We do not handle payments directly. For refund requests, contact Apple or Google support directly.

5. Your Content

You retain ownership of all content you create or upload to the Service ("Your Content"). By uploading content, you grant us a non-exclusive, royalty-free, worldwide licence to store, display, and process Your Content solely to provide and improve the Service.

You are responsible for ensuring Your Content does not violate any law or third-party rights. We reserve the right to remove content that violates these Terms.

6. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by Tameru and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.

8. Termination

You may stop using the Service and delete your account at any time through the app (Profile → Security & Privacy → Delete Account) or via our Account Deletion page.

We may suspend or terminate your access immediately, without notice, if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 9, 10, and 11 survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAMERU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will send a notice to your account email. Continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
